What is the Party Wall etc. Act and when does it apply?

The Party Wall etc. Act 1996 sets out a legal process for certain types of building work near a boundary or shared structure. It can apply if you are working on a wall shared with a neighbour (a party wall), building close to a neighbour’s structure, or excavating near their foundations. The Act is designed to reduce disputes by making sure neighbours are informed and protected.

Does serving a Party Wall Notice mean I’m in dispute with my neighbour?

No. A Party Wall Notice is simply a formal way of informing your neighbour about planned works that fall under the Act. Many neighbours consent without appointing surveyors. If there are concerns, surveyors can agree a Party Wall Award, which sets out how the work will be carried out and how any damage will be handled.

What is a Party Wall Award and what does it include?

A Party Wall Award is a legally binding document prepared by surveyors. It usually includes a description of the works, how and when they will be carried out, access arrangements if needed, and a record of the neighbour’s property condition before work starts (often supported by a Schedule of Condition). It also sets out what happens if damage occurs.
